By accessing or using the Xbooks Connect LLC website and services, you agree to be bound by these Terms of Use. If you do not agree, please do not use our website or services. We may update these terms from time to time, and continued use after changes constitutes acceptance of the revised terms.
Xbooks Connect designs, builds, hosts and manages digital platforms — websites, web and mobile apps, dashboards and automations — for businesses. Specific deliverables, timelines and fees for any engagement are defined in a separate statement of work or proposal agreed between you and us.
To access certain features you must register an account. You agree to provide accurate, current information, to keep your credentials secure, and to be responsible for all activity under your account. Notify us immediately of any unauthorized use.
Fees for one-time services and recurring subscriptions are described in your proposal or invoice. Recurring plans are billed in advance on the cycle you choose. Refunds, where applicable, are handled at our discretion and governed by the terms of your specific agreement. Disputed charges must be reported within 30 days.
You agree to provide timely access, content and approvals needed for us to deliver the work, to use the delivered platforms lawfully, and to ensure any content you supply does not infringe third-party rights. Delays caused by missing inputs may affect timelines.
Upon full payment of applicable fees, you receive a license to use the custom deliverables created for you. We retain rights to underlying frameworks, tools and code libraries developed prior to or independently of your project. Third-party components remain governed by their respective licenses.
You may not use our services to transmit unlawful, infringing or harmful content, to disrupt or compromise security, or to attempt unauthorized access. We may suspend access to protect the integrity of our services or other clients.
Our services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, or specific business outcomes such as revenue or rankings. Third-party services we integrate are subject to their own terms and limitations.
To the maximum extent permitted by law, Xbooks Connect LLC shall not be liable for indirect, incidental or consequential damages, or for any loss of profits or data, arising from your use of our services. Our aggregate liability is limited to the fees paid for the service giving rise to the claim in the preceding 12 months.
You may cancel recurring services per your plan terms. We may suspend or terminate services for breach of these terms or non-payment. Upon termination, your right to use the delivered platform ceases unless otherwise agreed, and you remain responsible for fees accrued.
These terms are governed by the laws applicable to Xbooks Connect LLC. Any disputes will be resolved in the courts of competent jurisdiction as determined by our registered operating jurisdiction, without conflict-of-laws principles.
